9. General Terms & Betting Rules
9.1. Type and Nature of Bets
9.1.1. It will be in the sole discretion of Betfred as to which markets may be offered by them, the events, or contingencies which it is prepared to accept bets or the nature of the bets that it offers. Furthermore, Betfred is not obliged to accept any bet or any bet type offered. Accordingly, Betfred reserves the right to refuse the whole or part of any bet without offering any explanation.
9.1.2. Betfred may from time to time determine a minimum or maximum amount that may be staked as a bet in respect of a market, whether generally or specifically. The Customer shall be responsible to inquire before placing a bet as to whether such maximum or minimum is applicable to a particular market and, if so, what the extent of such minimum or maximum is.
9.1.3. Betfred may determine a minimal and/or maximal on amounts that a customer may win or lose in respect of a bet, whether generally or specifically. The Customer shall be responsible to ensure before placing a bet as to whether such a minimal and/or maximal are applicable to a particular bet or market and, if so, what the extent of such minimal and/or maximal are.
9.1.4. Betfred may in its sole discretion from time to time offer the opportunity to Customers to place bets during a certain event (so-called “in running markets”). Betfred will, however, not accept any responsibility should there be an interruption of any “in-play markets” offered by them for any reason whatsoever.
9.1.5. The size and the nature of bets placed with Betfred will be determined from time to time at the sole discretion of Betfred and it shall be the responsibility of the Customer to inquire, before placing a bet, what the minimum/maximal is.
9.1.6. The maximum that any single customer (directly or indirectly) can win from all/any bets placed with Betfred on one day, irrespective of the stakes placed in terms of that bet, is based on the limits table and will never exceed 15 Million rands (Fifteen Million Rands) as in the case of lotto/numbers or 10 Million rands (Ten Million Rands) as in the case of pre-match soccer, per day per customer.
9.1.7. By using the Online Sports Betting facilities on the Betfred website, the Tele-betting service or placing a bet in one of our retail stores, you acknowledge that there is a risk of losing money and you will accept full responsibility for such losses.
9.1.8. You acknowledge and agree that your access to and use of the products and betting facilities offered on the Betfred website, and the use of the Betfred Group betting facilities service, or the Tele-betting service that is offered by Betfred, is at your option, discretion, and risk.
9.2. Acceptance of Bets
9.2.1. The Customer shall place his bets via the internet, or by the mobile betting platform, per telephone via the telephone number furnished by Betfred from time to time or, if made available by Betfred, through other electronic media. A bet placed with Betfred by SMS, fax or any other medium not prescribed and identified within these terms and conditions will not be accepted by Betfred and will be void ab initio unless otherwise advertised/agreed by Betfred.
9.2.2. Irrespective of the origin or location of the telephone call or electronic signal, a valid gambling contract between Betfred and the Customer shall only come into force if a bet is accepted and confirmed by a Betfred employee situated at, or electronic program operated from, any Betfred premises licensed in terms of the Law. Such bet will therefore be deemed to have been placed at such premises and all bets will be subject to these Terms and Conditions/Terms of Trade.
9.2.3. It shall be in the sole discretion of Betfred whether to accept or reject a bet.
9.2.4. The Customer authorizes and consents to each telephone conversation or electronic communication relating to a bet being recorded by Betfred in its sole discretion in such manner as Betfred deems fit to keep such recording for as long as Betfred deems necessary. Betfred shall be entitled to use such recordings for the resolution or litigation of disputes with the Customer or for any other lawful purposes.
9.2.5. The Customer shall have the sole responsibility of ensuring that the bet is accurately placed and recorded by Betfred. Betfred may/shall furnish such confirmation of a bet to the Customer as reasonably requested. Errors do occur and any dispute on a bet that is incorrectly captured or not captured at all, will have a maximum payout of R50 000 subject to agreement by Betfred.
9.2.6. Betfred shall be able to accept bets during normal business hours and at all such times as Betfred may seem fit.
9.2.7. The Customer shall solely be responsible for ensuring that he has full knowledge of the rules applicable to the market within which the Customer proposes to place a bet.
9.2.8. The placing of a bet signifies the Customers acceptance of Betfred rules and Terms and Conditions.
9.2.9. Betfred reserves the right to refuse the whole or any part of any bet without giving an explanation. Erroneously accepted bets over the limits can/may be adjusted at the sole discretion of Betfred.
9.2.10. Betfred endeavours to ensure complete accuracy as regards to announcing, displaying teams/players/venues, publishing and issuing of prices, off-times (start times of events) and results, however, should any error occur, Betfred cannot accept responsibility and reserves the right to correct any errors. In the case of any price related error a general market average price will be used.
9.2.11. Any bet not substantiated by Betfred betting terminals or tape-recording machines will not be recognized by Betfred.
9.2.12. Betfred cannot guarantee to pay or correct errors if they are brought to their attention more than 3 months after the official result of the last selection to run on the bet.
9.2.13. For all bets, the time at which the bet was recorded on the Betfred betting terminals will govern settlement.
9.2.14. If a bet is accepted after the “off” and is not marked inplay, the selection(s) will be null and void and of no force or effect. Any bets taken on results already known at the time of the bets placed will be voided/cancelled by Betfred.
9.2.15. Additional markets/new markets may be provided by Betfred from time to time, please read the "Market Rules" applicable before placing any bets. Should there be no market rules available for these new bet types, then standard industry betting rules will govern settlement.
9.2.16. It is a condition of Betfred’s acceptance of bets from you, and, by offering to place a bet with Betfred you represent and warrant that:
9.2.16.1. You are not prohibited from entering into the bet by any term of your contract of employment or any rule of a sport governing body which applies to you.
9.2.17. If Betfred, in its sole discretion, believes or has reason to believe that the bettor is using a non de plume (i.e. betting under an assumed name), with or without the other person’s permission, then the customer agrees that he/she shall forfeit all stakes in respect of such bets and Betfred shall not be obliged to pay any winnings which might otherwise have been payable in respect of the bets. In all instances, the onus to prove the validity of the bet shall rest with the customer.
9.2.18. Betfred reserves its right to freeze all accounts which it, in its sole discretion, believes or has reason to believe are suspicious pending an investigation by the relative authorities, be they Revenue Services and/or FIC investigators, Lotteries Board personal and personal verification by Betfred or its appointed agents.
9.3. Correction of Errors
9.3.1. Betfred reserves the right to correct any errors in odds offered by Betfred at any time by substituting the corrected odds as determined by Betfred, in its sole discretion in respect of the event concerned, for the original Betfred price, or the related market price, regardless of whether or not the bet has been struck, in which event you will be deemed to have been offered and where applicable, accepted and accordingly the bet to have been struck at the corrected odds.
9.3.2. Betfred reserves the right to correct any errors in sports betting handicaps offered by Betfred at any time by substituting the corrected sports betting handicaps as determined by Betfred, or the related market price, in its sole discretion in respect of the event concerned, regardless of whether or not the bet has been struck, in which event you will be deemed to have been offered and where applicable, accepted the corrected sports betting handicaps and accordingly the bet to have been struck at the corrected sports betting handicaps.
9.3.3. Betfred reserves the right to correct results where they have been previously incorrectly processed and paid. Betfred accounts which have been incorrectly credited with incorrect winnings as a result will be adjusted to reflect the corrected position or where customers are incorrectly paid in cash with incorrect winnings, then the incorrect winnings will be deducted from customers’ Betfred account, and account holders hereby authorise Betfred to do so and also waive all and any claim which they may have against Betfred for payment of any amount incorrectly credited to their accounts or incorrectly paid to them in cash.
9.3.4. Any error in venue, time, date, team composition, identity of any competitor or result of any past event in respect of any event advertised by Betfred, shall not entitle the customer to a refund of stakes or to void the bet concerned.
9.4. Dead Heat
9.4.1. In the event of a dead heat (tie), where odds were not offered by Betfred on such an outcome, bets will be paid at the face value of the ticket divided by the number of competitors tying for that placing. Place ties will only be paid on an event for which place betting was available, and the winnings thereon, will be calculated by dividing the value of the ticket by the remaining number of places available, and divided by the number of competitors tying for those available number of placings. In horse racing bets, your stake will be split by the number of other horse(s) in the dead heat, and multiplied at the odds of your bet, and you will lose the balance of the stake. Dead heat rules are calculated and applied in accordance with the applicable Gambling Board legislation.
9.4.2. In the event of a dead heat (tie) where odds were offered by Betfred on such an outcome, then all win and/or place bets will be losers and the draw option will be paid on the winner.
9.4.3. Save in respect of the aforegoing, and the specific sports betting rules, the dead heat rules above shall mutatis mutandis apply in respect of all sports / events and bets thereon.
9.5. Suspension of Markets
9.5.1. Betfred reserves the right to suspend a market at any time. When a market is suspended any bets placed during that suspension will be rejected and any bet accepted will be void.
9.6. Official Starting Time
9.6.1. The official starting time for any event is that stated by the controlling body for the relevant event.
9.7. Results
9.7.1. The result of any event will be accepted and posted by Betfred in accordance with the first official result of that particular event, irrespective of any subsequent revocation of that result due to disqualification or otherwise.
9.8. Special events
9.8.1. All special events on which bets are offered by Betfred shall be deemed to be sporting events even if they fall outside the scope of sport. All the Terms and Conditions relating to sport as well as the specific discipline rules in respect thereof shall apply to special event bets.
9.9. Sports Betting
9.9.1. In all betting relating to sports other than horse racing, the terms and conditions relating to betting on horses shall mutatis mutandis apply to all circumstances not covered by the specific sports discipline rules.
9.10. Maximum Winning
As a definition, Customer shall mean a customer, bettor, punter or syndicate of customers or any group of people acting in conjunction with each other, as may be determined by Betfred in its sole discretion.
9.10.1. If a number of bets containing the same or substantially similar selections are placed by more than one customer or by the same customer across multiple bets or tickets, and Betfred has reason to believe that these bets originated from or were placed on behalf of the same customer (including the same customer acting alone), syndicate of customers or any group of people acting in conjunction with each other (including, but not limited to, circumstances where bets are split into multiple tickets due to limits imposed by the wagering system, trading platform or risk management controls) as may be determined by Betfred in its sole discretion, Betfred reserves the right to: 1. Treat such bets as a single combined bet for settlement purposes, and/or 2. Void, refuse or restrict any bets or portions of bets which exceed system-imposed limits, or which are deemed to have been intentionally structured to circumvent such limits and/or, 3. Limit the total winnings payable in respect thereof to the maximum amount that a single customer may win on one day’s trading, being R15 000 000.00 (Fifteen Million) Rands, save in respect of the exceptions as aforesaid. Betfred, in its sole discretion, shall determine if a bet has been placed by a nominee or on behalf of a single customer and Betfred’s decision in that regard shall be final and binding. The acceptance of any individual bet or ticket shall not be construed as acceptance of the total combined stake where system limits have been exceeded.
9.10.2. Where bets have been placed on different days in respect of an event or events held on the same day, the maximum amount that one customer may win on one day’s trading is determined by the day that the final event/market is resolved, and not on the individual day on which each bet was placed and accordingly limited to a maximum amount of R15 000 000.00 (Fifteen Million) Rand per customer per day per event, save in respect of the exceptions as aforesaid.
9.10.3. Where a soccer multiple has 7 or more legs but also includes an event from another sport or horse racing, such multiple shall fall within the maximum winning category of that sport or horse racing.
9.10.4. Any bet placed by a customer in excess of the pay-out limit will be accepted, whether they are winning or losing bets, and paid out subject to the pay-out limits prescribed.
9.11. Related Bets
9.11.1. No related bets, (where the outcome of one part of the bet contributes or determines another part of the bet), will be accepted. If a related bet is accepted, the stake of the single bet will be divided and applied and paid equally over the respective events in the bet. Betfred, in its sole discretion, shall determine if a bet is a related bet, and Betfred’s decision in that regard shall be final and binding.
9.12. Multiple Bets
9.12.1. If any selection in a multiple bet becomes or is deemed void the money staked on that part of the bet which is void shall be placed on the remaining selections which comprise the multiple bet and the remaining selections of the bet shall stand. For example, if one match in a quadruple bet becomes void, the bet becomes a treble. If one bet of a multiple bet remains, that bet will stand as a single bet.
9.12.2. No multiple bet will be accepted where two legs of the multiple bet can be placed on and relate to the same individual event. For example, where one leg of a double is for Rosberg to qualify in pole position for the Monza Grand Prix and the second leg is for him to win the Monza Grand Prix. The two bets are connected in that they relate to the same race. Should any bets be erroneously accepted by Betfred, the stakes will be equally divided between the selections which are connected.
9.13. Payment in respect of a bet
9.13.1. In the application form, the Customer shall indicate that-
9.13.1.1. the Customer wishes to bet against a cash deposit placed with Betfred from time to time or an amount of cash to be drawn by Betfred as deposit from the Customers credit card account. The Customer acknowledges that such deposit is paid as security for the discharge by the Customer of any invoice which may become owing by the Customer to Betfred arising out if the agreement referred to in clause 2.1 or any bets placed.
9.13.1.2. The Customer shall under no circumstances place a bet or attempt to place a bet, the amount of which, together with any other bets then outstanding, exceeds the Customers credit balance with Betfred or the Customers credit card company, as the case may be, or the net amount on deposit with Betfred (after adjustment of taxes, winnings and losses up to the time of placing of the bet). It shall be the Customers responsibility before placing a bet to determine whether his credit balance or cash deposit, as the case may be, will be exceeded by placing a bet. If Betfred nevertheless accepts such a bet, it shall be entitled either prior to, during or after the outcome of the event or contingency upon which the bet was placed, to honour the bet or to refund the Customers stake in the bet irrespective and without any winnings thereon. Alternatively, Betfred may restrict the size of any stake without notification to the Customer to ensure that the credit limit or deposit, as the case may be, is not exceeded.
9.13.1.3. Acceptance by Betfred of a bet over the credit or deposit limit, as the case may be, shall not constitute a waiver of its rights:
9.13.1.3.1. to collect from the Customer all amounts (including losses) arising from such bet;
9.13.1.3.2. to enforce the appropriate deposit limits at any later time.
9.13.1.4. Betfred shall debit the Customer’s account in respect of bets accepted by Betfred and betting losses incurred by the Customer on an ongoing basis.
9.13.1.5. Betfred shall credit the Customer’s account in respect of winnings and refunds accrued to the Customers on an ongoing basis as a result of bets placed.
9.13.2. No interest shall accrue on any deposits held by Betfred and no interest shall be payable by the Customer to Betfred in respect of debit balances or amounts owing.
9.13.3. Provided that if the Customer is in a net winning position, Betfred shall settle the Customer’s account periodically as follows: payments will be made daily (Monday to Friday) or, if such day does not fall on a business day, then the next business day thereafter, by way of electronic transfer to the bank account specified by the Customer in the application form or in a subsequent written notice delivered to Betfred. Should banking be pushed through by Betfred before the close of business, then all payments requested after the banking time will be processed on the next working day. The customer acknowledges that this transaction may have a clearance period before the money is available for use by the Customer; or
9.13.4. The Customer shall on each Monday after a trading week or, if such Monday does not fall on a business day, then the next business day thereafter, pay to Betfred all such amounts as are owing to Betfred arising out of the Customers bets. Such payments may be made either-
9.13.4.1. by the Customer depositing the appropriate amount directly into Betfred’s bank account, in which event –
9.13.4.1.1. The Customer’s account number must be entered onto the base of the deposit and
9.13.4.1.2. a copy of the deposit slip must be retained by the Customer to facilitate resolution of disputes; or
9.13.4.1.3. by Betfred requesting a direct payment from the Customer’s credit card company,
9.13.5. Betfred,
9.13.5.1. shall under no circumstances whatsoever be liable to the Customer if the Customer’s credit card company refuses to honour the Customer’s credit card. No dispute of whatever nature between a Customer and his credit card company shall exempt the Customer from his liability to Betfred in respect of payment and the Customer shall not be entitled to instruct Betfred to reverse a payment instruction that has already been made to the Customer’s credit card company;
9.13.5.1.1. shall not be responsible for any failure, malfunction or delay of any electronic funds transfer unit or other credit card processing machine or its supporting or sharing network, resulting from circumstances beyond Betfred’s control, nor shall Betfred be liable for any damages, loss or expense which the Customer may suffer as a result thereof;
9.13.5.1.2. shall furthermore not be liable for any loss or damage suffered by the Customer as a result of the unauthorized access to any data or as a result of incorrect information supplied through an electronic funds transfer unit or other credit card processing machine or its supporting or sharing network.
9.13.5.2. The Customer shall be entitled at any time at his discretion to restore or add to any cash deposit which has been diminished as a result of a settlement.
9.13.5.3. The Customer undertakes that he shall place a bet with Betfred within 14 (fourteen) days after making a cash deposit failing which Betfred may be entitled to return the cash deposit to the Customer and charge an administration fee of 6%.
9.13.5.4. Betfred shall, when the customer’s account is suspended or terminated, be entitled to consolidate all amounts owing by the Customer to Betfred (even if more than one account has been opened), by reason of the fact that a Customer’s account was used, and to debit such amounts to one or more of the Customer’ accounts with Betfred and to demand payment thereof without such consolidation bringing about a novation of any aforementioned amount owing. Such consolidation shall not prejudice the right of Betfred to demand any amount not included in such a consolidation.
9.13.5.5. Betfred may at any time adjust or cancel the Customer’s credit limit.
9.13.5.6. Betfred shall send by post/email a statement of account in respect of the Customer’s account to the Customer at such request. Non-receipt of a statement will not entitle the Customer to withhold any payment to Betfred.
9.13.5.7. Notwithstanding anything to the contrary herein contained, Betfred shall be entitled to set-off any amount(s) due by the Customer against any funds standing to the credit of any of the customer’s accounts with Betfred or to realize any security held by Betfred and to use the proceeds towards payment of any amount due by the Customer to Betfred.
9.13.5.8. Betfred may at its own discretion and from time to time determine how payments by the Customer to Betfred shall be appropriated in respect of amounts owing the Customer to Betfred.
9.13.5.9. A certificate signed by any director, manager, assistant manager, trader or accountant of Betfred (whose appointment need not be proved) stating the amount of the Customer’s indebtedness to Betfred, shall be prima facie proof of such indebtedness.
9.13.5.10. If the Customer is in arrears in paying any amount owing by the Customer to Betfred, such amount shall bear interest at the prime overdraft rate for interest ruling from time to time, expressed as a rate per annum, calculated daily and compounded monthly in arrears at which the Standard Bank of South Africa Limited lends on overdraft to its most favourite corporate customer from time to time. A certificate (whose appointment or authority need not be proved) as to the prime rate at any time shall, in the absence of manifest error, be final and binding on the parties.
9.13.5.11. All taxes and/or levies shall be paid over to the South African Gambling Board.
9.13.5.12. In the event that funds are incorrectly credited to a customer’s account, it is incumbent on the customer to notify Betfred of the aforesaid error without delay. Unless otherwise notified by Betfred any transactions resulting from the error shall be void.
9.13.5.13. Credit and Debit card deposits may only be made by the cardholder whose name is displayed on the card, which must match the name in which the Betfred betting account is held.
9.13.5.14. Betfred reserves the right to charge a 5% administration fee on amounts deposited by credit card.
9.13.5.15. Once you have committed a payment via your credit card to Betfred, until payment for the transaction has been banked into Betfred's bank account, the Betfred account holder is personally liable to Betfred for all and any monies/payments outstanding on any credit card.
9.14. Customer Data
9.14.1.1. The Customer acknowledges that Betfred will be required to supply his/her personal details and transaction records to any statutory body that legally requests or requires access to such data. The Customer acknowledges that Betfred makes no guarantees with regard to the privacy thereof.
9.14.1.2. The Customer (both online and retails) consents to checks being made against appropriate 3rd party databases to verify identity, personal details or credit card information, and any other information supplied by the Customer that Betfred deems necessary to acquire independent verification. The parties with which Betfred contracts for the verification of information may keep records of all data requests and data submitted to them by Betfred
9.15. Termination
9.15.1. Betfred shall have the right prior to accepting any bet, to suspend temporarily or permanently, the furnishing of betting services to a Customer without assigning any reason therefor. Upon such suspension or termination-
9.15.1.1. Betfred shall upon the demand of the Customer, refund to the Customer the
9.15.1.1.1. Balance of any monies held by Betfred on deposit for the Customer, after
9.15.1.1.2. Adjusting for losses, winnings and taxes and once such funds have been cleared into Betfred’s bank account;
9.15.1.2. all amounts owing by the Customer to Betfred shall become payable immediately once all verifications are in place.
9.15.2. The Customer shall upon written notice to Betfred be entitled to terminate its Contractual relationship with Betfred at any time after final conclusion of any betting transaction placed by the Customer and after payment by the Customer of all amounts owing by the Customer to Betfred. Betfred shall within a reasonable time after such termination, refund to the Customer the balance of any monies held by Betfred on deposit for the Customer, after adjusting for losses, winnings and taxes. After such termination, Betfred shall accept no bets from the Customer unless and until a new registration is accepted by Betfred.
9.15.3. Should the Customer default in the performance of any of these Terms and fail to remedy such default within 48 hours after receipt of written notice by Betfred requiring the Customer to do so, Betfred shall be entitled without prejudice to any other rights it may have in law forthwith to terminate its contractual relationship with the Customer and to terminate or suspend any bet placed by any such Customer, whether accepted or not, and/or to claim damages from the Customer. In such event –
9.15.3.1. all amounts owing by the Customer to Betfred shall become payable immediately; and
9.15.3.2. Betfred shall have a lien and right of retention over all monies of the
9.15.3.3. Customer on deposit with Betfred, pending settlement of Betfred’s damages.
9.15.4. Notwithstanding the generality of the provisions of these terms and conditions, the Customer shall be deemed to be in default if –
9.15.4.1. the Customer is an individual who dies or is sequestrated or surrenders his/her estate; or
9.15.4.2. the Customer is a partnership which is dissolved; or
9.15.4.3. the Customer is a company or close corporation which is placed under a provisional or final order of liquidation or judicial management; or
9.15.4.4. the Customer compromises or attempts to compromise with any of the Customer’s creditors.
9.15.5. The Customer shall be liable for any legal expenses (including legal expenses of a
9.15.5.1. client attorney scale, collection charges and tracing fees) as well as any amount
9.15.5.2. governmental tax including but not limited to value-added tax, which Betfred
9.15.5.3. may incur in recovering any amounts owing in respect of the Customer’s account
9.15.5.4. or a result of the Customer’s breach of any of the conditions of use or the
9.15.5.5. enforcement by Betfred of any of its rights against the Customer.
9.16. Limitation of Liability
9.16.1. The liability of Betfred to the Customer for any damages sustained by the Customer from any cause whatsoever including any damages arising out of the Negligence of Betfred or that of its servants, agents or sub-contractors, shall in Any event and under all circumstances be limited –
9.16.1.1. in the event of damages relating to a bet, to the amount staked by the Customer in respect of such bet; or
9.16.1.2. In respect of the account of the Customer with Betfred, to the credit balance of such account at the time during which the damages are alleged to have occurred, after adjusting for winnings, losses and taxes.
9.16.2. Notwithstanding any other provisions in these Terms, Betfred shall in no circumstances whatsoever be liable for any loss of profits, winnings or potential profits or winnings or any indirect or consequential damages sustained by the Customer, whether or not caused by the negligence of Betfred, its agents or employees.
9.16.3. Insofar as any of the obligations of Betfred under these Terms are carried out by any its servants, agents, sub-contractors, associates or subsidiaries, the provisions of these Terms and Conditions are stipulated for their benefit as well as the Customer and each of them shall be exempted accordingly.
9.16.4. Betfred shall not be liable if the Customer is unable to place a bet due to among other things, congestion on the telephone lines, telephone system failure, telephone exchange failure, network failure, internet failure, electricity failure etc or on any other electronic media used by Betfred.
9.16.5. Any acts of God, war, strike, lock-out or other labour dispute, fire, flood, explosion, legislation, failure of electricity or any other supplies, failure of telecommunications, failure, theft or default of any computer hardware or software or any other equipment or any other similar or different cause beyond the reasonable control of Betfred leading to the cessation and/or restriction of the operations of Betfred, shall entitle Betfred to postpone its obligations to the Customer in whole or in part, and in such event Betfred shall not be responsible for any damages, whether direct or indirect, suffered by the Customer as a result thereof and the Customer shall not be entitled to terminate its contractual relationship with Betfred as a result of any such occurrence.
9.17. General
9.17.1. The residential address which the Customer furnished on the application form serves as his domicilium citandi et executandi for all purposes in respect of these Terms and any bet. Any change of the said domicilium can only be affected after Betfred has received from the Customer in writing another complete residential Address within the boundaries South Africa.
9.17.2. Betfred may at any time amend, recall, replace and/or add to one or all of these Terms in the manner that Betfred may think fit, which shall constitute sufficient notice thereof to the Customer and shall bind the Customer as if it expressly agreed to be bound thereby.
9.17.3. In respect of any lawsuit with regard to a bet or the Customer’s account with Betfred, the laws of the South African Government shall be binding.
9.17.4. Any relaxation or concession or extension granted by Betfred to the Customer shall not be and shall not be deemed to be a novation or waiver of any of Betfred’s rights in respect of the Customer.
9.17.5. Betfred is entitled to supply any relevant credit information pertaining to the Customer and his account with Betfred to a credit bureau should Betfred deem it necessary to supply said information, and the Customer shall have no right of recourse against Betfred by reason thereof.
9.17.6. The conditions set out herein shall constitute the whole agreement between Betfred and the Customer and no agreements, representations or warranties, Other than those set out herein, shall be binding on Betfred or the Customer.
9.17.7. No addition to, variation, consensual cancellation or navation of any of the conditions set out herein and no waiver of any of the rights therefrom shall be of any force and effect unless reduced to writing and signed by Betfred and the Customer or their duly authorized representatives.
9.17.8. Any promissory note, bill of exchange, or other negotiable instrument received by Betfred from the Customer shall not be a novation of the debt for which it is given and the Customer waives presentment, notice of dishonour and protest where applicable.
9.17.9. Any bet placed by the Customer shall be governed by the Law, the provisions of which the Customer shall at all times adhere to. The Customer undertakes to Strictly adhere to any directive from the relevant Gambling Board relating to the Customer or to betting generally.
9.17.10. These Terms and the contractual relationship between the Customer and Betfred shall be governed by the laws of the South African Gambling Board and various Provincial Gambling Boards.
9.17.11. If the Customer originates the placing of a bet from outside the South African monetary area, such bet shall be subject to all appropriate exchange control Regulations and the laws of the foreign jurisdiction from which such telephone calls or electronic instruction originates and it is the Customer’s responsibility to keep himself informed of such laws and regulations and act accordingly when placing a bet. Betfred makes no warranties and shall not be liable to the Customer if it is not able to remit any monies held by it to the Customer’s account in a foreign jurisdiction.
9.17.12.1. any reference to “he”, “his” or “him” shall also include “she”, “it”, “her” or “its”;
9.17.12.2. the singular shall include the plural and vice versa;
9.17.12.3. any reference to natural persons shall include created entities (corporate or incorporate) and vice versa;
9.17.13. Should Betfred, in its own and absolute discretion, allow a registration Form to be completed, or a bet to be placed, by a partnership, syndicate, joint venture, club or association, each member of such partnership, syndicate, joint venture, club or association shall be jointly and severally liable with each other member notwithstanding that such member has not completed the application form or placed the bet.
9.17.14. Should Betfred, in its own and absolute discretion, allow a registration form to Be completed, or a bet to be placed, by a company or close corporation respectively hereby binds himself jointly and severally as surety and co-principal debtor for all debts to Betfred arising from the placing of bets by the company or close corporation, as the case be, from time to time.
9.18. Cancellation of Bets
9.19.1. It is the client's responsibility to ensure all details of their bets and/or selections are correct.
9.18.2. Once a bet has been placed and acceptance confirmed, it cannot be cancelled, changed or modified in any way.
9.18.3. Should there be a dispute in respect of any bet, Betfred's transaction log database will be final in determining the outcome of the dispute.
9.19 Price Boosts
9.19.1 Boost prices are fixed at the time of publication. If regular odds later move to match or exceed the Boost, your bet will still stand at the published Boost price.
9.19.2. If any part of a Boost (team, player, or event) is cancelled, voided, postponed beyond 24 hours, or otherwise invalid, the entire Boost bet will be void, with stakes refunded in full.
9.19.3. Cash Out is not permitted on Boosts.
9.19.4. Betfred may set maximum stake and/or maximum payout limits on Boosts. These may differ from standard market limits.
9.19.5. Price errors may be corrected by applying a historical average Boost price to the market.
9.19.6. If a Boost is published with incorrect teams, runners or players, the bet will be void and stakes refunded. For start times, bets placed after the actual kick-off/start time of any boost will be void and refunded.

9.19.8. Unless otherwise stated, Boosts are settled according to the standard rules of the relevant sport and racing events. For football, this means the 90-minute rule (normal time only, excluding extra time and penalties).Available here: https://betfred.co.za/page/betting-rules.
9.19.9. Boosts are for recreational use by individual customers.
9.19.10. Duplicate accounts, collusion, or syndicate betting may result in voided bets and/or account restrictions.
9.19.11. Price Boosts cannot be used in conjunction with any other promotions, offers, or bonuses.
9.19.12. Betfred reserves the right to amend, suspend, or withdraw Boost offers at its sole discretion without prior notice.
9.20 Lost, Destroyed or Misplaced Tickets
9.20.1 In the event that a betting ticket is lost, destroyed or misplaced, no payment shall be made unless the Customer follows the prescribed lost ticket claims procedure. The Customer shall be required to submit a written claim supported by an affidavit detailing the circumstances under which the ticket was lost or destroyed.
9.20.2 Betfred reserves the right to verify the validity of the claim against its records and may withhold payment for a period of up to ninety (90) days from the date on which the winnings became payable, or such longer period as may be reasonably required, in accordance with applicable legislation and regulatory requirements.
9.20.3 Under no circumstances will any ticket be paid more than once.
